ACCEPTABLE USE POLICY

This Acceptable Use Policy (the AUP) outlines the permitted and prohibited uses of the Stahili App (the App), any affiliated digital platforms, websites, software interfaces, or electronic mediums operated by Stahili Commerce Limited (the Campany). By accessing or using the App, you agree to comply with this AUP alongside the Terms of Use, other policies or platform-specific guidelines.

The Company reserves the right to amend the AUP at any time. These modifications and special conditions shall apply and in case of any conflict, the specific modifications or special conditions shall prevail. Members (the Members) are responsible for reviewing the AUP periodically and must read and accept any applicable special conditions before accessing the App, any affiliated or owned digital platforms, websites, software interfaces, or electronic mediums. By continuing to access the Member Account (the Account) after a revised version of the AUP has been posted, the Member agree to comply with the latest version of the AUP.

The Company reserves the right, at its sole discretion, to monitor, investigate, and audit any Member Account, activity, or content to ensure compliance with this AUP, the Terms of Use, and applicable laws. The Company may request additional information from Users, including identity verification or proof of transaction legitimacy, to verify adherence to this AUP, and may cooperate with law enforcement or regulatory authorities in investigations related to alleged violations

Where the Company reasonably determines that a Member has violated this AUP, it may, without prior notice: (a) temporarily suspend or permanently delete the offending Member Account; (b) forfeit any accrued rewards, benefits, or privileges associated with the Account; (c) disqualify the Member from future participation in surveys, competitions, or rewards programs; and/or (d) take legal or remedial action, including reporting unlawful conduct to authorities. The Company's determination of an AUP violation shall be final and binding, subject only to the dispute resolution mechanisms in the Terms of Use. Users waive all rights to challenge such determinations in court or other forums, except where expressly permitted under Kenyan law.

The Company shall not be liable to Users or third parties for any loss, inconvenience, or damages arising from: (a) account monitoring, suspension or deletion; (b) forfeiture of rewards due to AUP violations; or (c) investigative delays or errors.

The Company may offer translations of these AUPs in different languages for convenience and informational purposes only. The legally binding version shall be the English text. If there is any inconsistency between the English version and a translated version, the English version shall govern and take precedence.

The Member is advised to carefully review the AUP in conjunction with any other applicable policies (or any supplementary privacy notice provided when we collect or process your personal data). This ensures you fully understand the AUP. The AUP operate alongside and do not override such policies

The Member is advised to keep a printed or saved copy of the AUP for future reference.

If the Member feels that any use or access of the App, any affiliated digital platforms, websites, software interfaces, or electronic mediums Member of the Products has violated this AUP, please contact us at hello@stahili.com.
